The consumer declares to have read the following provisions before placing an order in the shop. By choosing to buy products online, you accept the terms set out below.

PRICE
All the prices indicated in our catalog are net starting prices, all taxes included in Euros, and are subject to change without notice. Shipping costs will be calculated on the order form.
The customer agrees to pay the sale price in force at the time of entering the order.

REGULATION
Payment is made when ordering by check (bank domiciled in France or Monaco), by returning the order form (printable version) accompanied by your payment by check to the following address:

The transfer of ownership will only take place after full payment by the buyer (law of 12/05/1980).

VALIDITY OF AN ORDER
From the last "acceptance click", the order is considered irrevocable and can only be called into question in the cases limitedly provided for below as "right of withdrawal" and "availability of products".
An email confirming the contractual information of your order will be returned to you as soon as it is registered. By keeping this email and/or printing it, you have proof of your order that we recommend that you keep.
This last "click" is assimilated to the handwritten signature referred to in article 1341 of the French Civil Code (law of March 13, 2000 on electronic signature).
By sending the order form and the check, you authorize EARL ESCOI to debit your account for the total amount of your order.
Any order will only be processed upon receipt of your check.

EARL ESCOI notably reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. .

As part of its order verification procedure, EARL ESCOI may ask the customer to send it a copy of an identity document and proof of address by email. The order will only be validated after receipt and validation of these documents. This procedure is intended in particular to ensure that no one uses the bank details of another person without their knowledge.

SHIPPING COSTS - POSTAGE PAID FOR FRANCE.
The costs will be calculated automatically and stipulated online on the order form (at the "Confirmation" stage of the online ordering procedure).

PRODUCT AVAILABILITY
In case of unavailability of the product ordered, in particular because of our suppliers, the consumer will be informed as soon as possible and will have the possibility of changing or canceling his order. The consumer will then have the choice of requesting either a refund of the sums paid within 30 days at the latest of their payment, or an exchange of a product of equivalent characteristics and price, if EARL ESCOI is able to obtain it.
If it is impossible to exchange, EARL ESCOI reserves the right to cancel the order and refund the sums paid.
The information on the availability of the products being transmitted by our suppliers, the unavailability of the product could not engage the responsibility of EARL ESCOI nor give right to damages for the customer.

Special condition:

In the event of a change of vintage on a product, EARL ESCOI will inform the customer by email upon receipt of the order. The customer may, if he wishes, within 24 hours refuse the new vintage and request an equivalent product of the same price in exchange or cancel his order and obtain a refund of the amount paid. After this time, the order will be considered validated and shipped.

 

DELIVERIES
The products ordered will be delivered to the address indicated by the consumer on the order form and only in metropolitan France. The maximum expected delivery time is 10 (ten) working days from receipt of payment. 
Any anomaly upon receipt of packages (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of handwritten reservations accompanied by the customer's signature and reported. to the carrier as well as to EARL ESCOI within two working days.
However, we cannot be held responsible for an impossibility of delivery beyond our control (absence, error in wording, address, unavailability of stock, difficulties encountered by the carrier, etc.).

RETURN OF DELIVERY
Pursuant to article L121-16 of the Consumer Code, the consumer has a period of 14 working days to return, at his expense and risk, for exchange or refund, wines that do not suit him. This period runs from the day of delivery of the consumer's order. If this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.

All returns must be reported in advance to EARL ESCOI Customer Service by e-mail (earl-escoi@orange.fr). A return number will then be assigned to the product. The wines must be returned by Colissimo Recommandé to EARL ESCOI  2 route de Saint-Couat 11700 Roquecourbe-Minervois.
The pre-paid cases of wine must not have been opened, so that the consumer can benefit from the right of withdrawal.

Only cases of wine returned as a whole will be taken back, in their complete and intact original packaging, and in perfect condition for resale. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.

This right of withdrawal is exercised without penalty, with the exception of return costs. In the event of the exercise of the right of withdrawal, the consumer has the choice to request either the reimbursement of the sums paid, or the exchange of the product. In the case of an exchange, the re-shipment will be at the expense of the consumer.

In the event of exercise of the right of withdrawal, EARL ESCOI will make every effort to reimburse the consumer within 30 days.

The consumer will then be reimbursed by cheque.
No returns will be accepted and we do not proceed to any exchange beyond the regulatory deadline.

Any return due to an error of address or an impossibility of delivery not attributable to EARL ESCOI will be re-invoiced.

JURISDICTION
These general conditions of sale are subject to French law. In the event of a dispute or dispute, only the Commercial Court of Béziers will be competent, even in the event of multiple defendants or warranty claims.

MINORS ANDABILITY LEGAL
Ordinance No. 59-107 of January 7, 1959 and Law No. 74-631 of July 5, 1974 prohibit the sale and supply of alcoholic beverages to minors and similar persons.
Therefore, by completing your Order Form, you acknowledge that you have the legal capacity to enter into this contract.
